DL Partners’ real estate practice covers a broad spectrum of services including acquisitions, sales and financings of commercial, multi-family and individual residential properties, commercial leasing, development and construction matters, the transfer of development rights, merger of zoning lots, and the application and compliance with tax abatement and incentive programs. We represent a wide array of parties including owners, developers, contractors, brokers, lenders and borrowers.

With respect to the development of condominiums and cooperative corporations, we routinely draft offering plans and no-action letters for the conversion of both new construction and existing properties in New York State.  We also obtain the subdivision of tax lots in connection with the creation of condominiums. Our firm also represents condominium associations and cooperative corporations both as general counsel and as litigation counsel.  Working alongside our corporate department, we draft condominium and cooperative organizational documents, as well as alteration agreements, license and access agreements and other corporate documents. Additionally, we advise our clients and assist with the negotiation of service contracts and serve as transfer agent to cooperative corporations.

To meet the needs of ground-up development, we draft and negotiate sophisticated development rights agreements, zoning-lot development and easement agreements and inclusionary zoning documents for New York State properties. We also draft and negotiate construction agreements with contractors, construction managers and architects.

We have the knowledge and experience necessary to guide our clients through the application process for tax exemption and abatement programs available in the City of New York. DLPartner’s real estate tax exemption practice consists of assisting clients in navigating through the complicated regulatory approval process of obtaining and maintaining various New York City real estate tax exemption and abatement benefits, including (420-a, 421-a, 421-a(16) Affordable New York Program, 421-b, 421-g, J51, Industrial Commercial Incentive Program (ICIP) and its successor the Industrial Commercial Abatement Program (ICAP)), for condominium, rental, residential, commercial, community facility and mixed-use properties.

Our real estate department regularly collaborates with our litigation department in construction law matters such as access agreements, adverse possession claims, construction law and title issues. The collective capabilities of these departments places us in a unique position of representing title companies in the defense of title claims.

Our leasing department is experienced in commercial leasing on behalf of both owners and tenants. Our practice includes commercial, retail, office, loft, supermarket and restaurant leases, shopping center leases, ground leases and assignments of leases and sublets.
