Eric R. Garcia is one of the firm’s commercial litigators, with extensive experience in complex civil and commercial litigations in New York’s State, Federal and Appellate Courts. He also works on resolving clients’ disputes in various alternative ADR forums such as arbitrations and mediations, and his practice includes real estate/construction disputes, condominium/cooperative disputes, and the prosecution and defense of general commercial disputes for the firm’s various clients. In addition, Mr. Garcia expends a large portion of his practice in counseling condominium boards and unit owners, both in residential and commercial/retail buildings, in all aspects of corporate governance, board elections and disputes, review and enforcement of building by-laws and declarations, and in the negotiation and approval of detailed alteration/build-out and license agreements. Mr. Garcia also regularly handles the prosecution and defense of commercial leasing disputes including the negotiation of surrender agreements, both pre-litigation and before New York City’s various commercial Civil Courts (Part 52). Mr. Garcia also routinely appears before New York City’s governmental agency tribunals on behalf of the firm’s clients/buildings to resolve local agency violations and fines, both civil (e.g., ECB, DOB, NYC Commission of Human Rights) and criminal (e.g., FDNY SAP-2A).
Notably, working in collaboration with the firm’s real estate tax-incentive department, Mr. Garcia won Article 78 judgments against New York City government agencies resulting in the firm’s developer clients recovering several million dollars in projected tax incentive benefits.
