Susan M. Scharbach is Special Counsel at the firm. Ms. Scharbach represents clients in a variety of real estate matters with a particular focus on filing offering plans and No-Action Letter Applications. Additionally, she resolves enforcement complaints in negotiations with the New York State Attorney General’s office and files applications for real estate tax incentive benefits with the City of New York, Department of Housing Preservation and Development for affordable, rental and condominium developments. Ms. Scharbach also plays a vital role in assisting the transactional team at DL Partners in negotiating Declarations and By-Laws on behalf of the purchasers of commercial condominium units and drafting condominium and commercial leases while addressing tenant and ownership issues.
Prior to joining the firm, Ms. Scharbach was the Deputy Bureau Chief in the Real Estate Finance Bureau (“REF”) of the New York State Attorney General’s office. During her tenure as Deputy Bureau Chief, Ms. Scharbach drafted revisions to regulations and policy statements, conducted enforcement investigations, negotiated settlement agreements, responded to lawsuits and spearheaded special projects for REF. In her role at REF, she also reviewed a wide variety of complex offering plans, including timeshare resort plans, condominium hotel offerings and tenanted conversions.
Susan currently serves as a member of the Executive Committee of the Real Property Law Section of the New York State Bar Association and is Co-Chair of the Website and Electronic Communications Committee. Ms. Scharbach has often been called upon to speak at CLE presentations and other forums and frequently addresses questions related to her knowledge of REF’s requirements and procedures.
